William BRYER's Will of 1767
This is the last will and testament of me William BRYER of Dorchester in the County of Dorset Gentleman made and published this ninth day of September in the year of our lord one thousand seven hundred and sixty seven. ffirst I do desire and direct that that all the business of all sorts that I now carry on and am concerned in be carried on by my dear wife and my son Edmund in the manner and places I now carry on the same for the first four years after my decease and I do direct that the clear profits of all such business during the said four years be first of all subject in manner following To support my son Thomas in the University and for that purpose I do direct that out of the said clear profits thereof an annual sum of thirty five pounds be paid to him for that purpose during the said four years and subject thereto I do direct that the remaining clear profits thereof during the said four years be equally paid and divided to and amongst my said dear wife and all and every my children, except my said son Thomas, in equal shares and proportions and at the end of the said four years I do direct that a just inventory be made of the stock and effects in the said business and a just division thereof be made to and amongst all and every my children and my said dear wife in equal shares and proportions in order that my said dear wife or such of my children as are then desirous of it, may then take out their respective parts and shares out of the the said business and leave the same also I do direct that all my just debts be paid and discharged Also I give and devise all that my messuage and tenement called the King's Arms Inn situate in Dorchester aforesaid with its appurtenances unto my son William BRYER his heirs and assigns for ever In trust however that he shall sell the same as soon as is convenient after my decease for the best price that can be got and whose receipt for the consideration money shall be a sufficient discharge for the same and that he shall pay and divide the money arising by such sale to and amongst himself and all every other of my children that I shall leave at my decease in equal shares and proportions and in the meantime and until such sale the rents of the said premises be in like manner paid and divided to and amongst all my said children Also I give and devise all my houses lands tenements and hereditaments lying in Weymouth and Melcombe Regis in the said County unto such of my four youngest children in fee simple as my said dear wife who is intitled to the same for her life shall by her last will direct and nominate and for want of such direction and nomination I do then give and devise the said lands and hereditaments to the four youngest of my children that I shall leave at my decease their heirs and assigns for ever to take as Tenants in Common not as Joint Tenants And I do direct that my said dear wife shall enjoy her widowhood in my copyhold estate in the Manor of fforthington according to the custom of the said Manor and after the determination thereof I do give and bequeath the said copyhold premises to my son John Bampfield BRYER for his life, and after his decease I do give the same to my son Edmund BRYER for his life, whose two lives are with my own now subsisting on the said premises. All the rest and residue of all and singular my real and personal estate whatsoever and wheresoever I give devise and bequeath the same unto my son William BRYER his heirs executors and administrators in trust however to and for himself and all and every other of my children to be divided amongst them all in equal shares and proportions And I do make and appoint my said son William and my dear wife executors of this my will and I do desire my said dear wife and my said son William to be trustees and guardians to my three youngest children. This Will was proved at London the twenty fourth day of October in the year of our lord one thousand seven hundred and sixty seven before the Right Worshipfull George Hay Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the oaths of William BRYER the son and Sarah BRYER widow the Relict of the deceased and executors named in the said will to whom Administration was granted of all and singular the Goods Chattels and Credits of the said deceased they having been first sworn duly to administer that is to say The said William BRYER before the Worshipfull George HARRIS Doctor of Laws and Surrogate and the said Sarah BRYER by Commission.
